What does the new law say?
The Employment (Miscellaneous Provisions) Act 2018 has been called “one of the most significant pieces of employment legislation in a generation”.
And it’s no wonder when it brings new protections for people on insecure contracts or who work variable hours. Here’s how the law has changed:
- You must give all new starters (and existing staff) five core terms of employment in writing, within five days of starting work. One of these terms is to tell your staff the expected length of their normal working day and week.
- Zero hour contracts are banned except for two circumstances: if it’s an emergency or you need to arrange short-term cover for routine absences.
- There’s new protection for employees who are scheduled to work but not called in. Affected employees are now entitled to receive a minimum payment of no less than three times the National Minimum Wage, or three times the Employment Regulation Order hourly rate.
- Employees have the right to request ‘banded hours’. This is the range of hours your employee has actually worked over a 12 month period, and it can be different to what’s on their contract.
As you can see, the Employment (Miscellaneous Provisions) Act 2018 makes it even more important to keep a record of your staff’s work hours.
