Employment disputes can be messy, lengthy, and certainly undesirable for both employees and employers. Various cases can take years to resolve, with significant costs and time spent especially on smaller disputes.

To address this, the Australian government will be creating a specialised Fair Work Court for these matters. Aimed at making it easier for cases to be solved, the court will streamline solving disputes while providing a fairer experience for all parties involved.

How the court will operate

According to a press release from the Albanese government, the new Fair Work Court is aiming to provide resolutions which are fairer and quicker for employees engaged in employment disputes. It is a direct response to several disputes taking longer than necessary to resolve while also significantly costing businesses. Another aim of the court is to address disputes where cases can cost more than a claim itself, providing a fairer option for employees reluctant to seek justice.

While complete details are still yet to be revealed, the court will include judges with extensive workplace relations expertise, allowing the process to be much faster and simpler for all parties involved. Underpayment claims will be a major focus for the Fair Work Court, removing several cases from backlog in the current court system while making it much easier for cases to be resolved.

While further details will be released soon, as a business owner it’s essential to be aware of the implications of the new court and the effects it may have. If your company is involved in any employment relations disputes, your HR team needs to be fully aware of what to expect and how to navigate the changes.
